I know some of you have done a fair share of jury duty HITs, so you probably can help me here.

Quick question. Just hypothetically speaking, if someone were to hit a man with their car in an Applebee's parking lot at roughly 3:30 am last night, do you think it's possible to successfully argue in court that it wasn't their fault because the guy was wearing a dark navy blue hoodie and was very hard to see? And also that it wasn't their fault that they subsequently dragged the guy almost halfway across the town while driving home and only noticed it when the song ended and they realized those annoying screaming and scraping noises they were hearing the entire time were not, in fact, part of the song?
